Meesho Limited (the “Company”, “We”, “Us”, “Our”, and “Ourselves”) operate and make available the services under the brand name “Valmo”. Valmo operates and manages its website available at https://www.valmo.in/ and/or mobile applications called Valmo Pilot (collectively, the “Platform”), through which the services offered by the Company are made available (the “Services”).

We place the utmost importance in maintaining the confidentiality, integrity, and security of your (collectively, “You”, “Your”, “Yourself”, and “Users”) personal data and information that You may provide while accessing or using the Platform or the Services, including information provided to enable Us to provide specific support or services requested by You. Our comprehensive Privacy Policy / Privacy Notice (as defined below) reflects this commitment, and We encourage You to read it carefully.

This document (the “Privacy Notice” or “Privacy Policy”) explains how information, including Personal Information (as defined below), is collected, received, stored, processed, used, disclosed, transferred, retained, or otherwise handled by Us in connection with the Services. This Privacy Notice is incorporated into and shall be read harmoniously with Our applicable Terms of Use (“Terms”). All capitalised terms used herein but not defined in this Privacy Notice shall have the meanings ascribed to them under the Terms.

This Privacy Notice is governed by one fundamental principle - maintain Your trust and confidence when handling Your Personal Information. Our Privacy Notice broadly lays out the following:

This Privacy Notice does not cover information You may provide to third-party websites, applications or services that are not owned or controlled by Us. This includes third parties We advertise on the Platform or otherwise or on social media sites where We have a profile. This includes, but is not limited to, communications over third-party messaging platforms. Such information will be governed by the privacy policies of respective third parties, and such sites.

Personal information is any information relating to an individual where such individual is identifiable by or in relation to such information (“Personal Information”). We may collect such information from You directly or through third parties. While We have specified the exact categories of Personal Information collected by Us and the purposes of such collection in this Privacy Notice, set out below is a broad description of the nature of Personal Information that may be collected from You:

  1. Payment and transaction-related information, including billing details, payment instrument information, transaction history, and other information relating to transactions in which the Company is involved;

  1. Geographical and location information, including real-time GPS location or approximate location data, where enabled or permitted by You;

  1. Device permissions and media, including access to camera, microphone, device storage, and photographs or profile pictures (if any), including images that may be publicly displayed as part of Your account profile;

  1. Information provided during the use of the Services, including details relating to assets used by You for providing services, and information relating to Your third parties, subcontractors, agents, or representatives;

  1. User communications, including emails, chats, messages, call recordings, service requests, feedback, survey or poll responses, comments, pictures, preferences, and communications with Us or customer support facilitated through the Platform;

Device-related and technical information, including device type, device identifiers, operating system, browser type, IP address, mobile network information, internet connection details, access times, logs, views, cookie identifiers, and information collected through cookies, web beacons, web storage, unique advertising identifiers, and similar technologies;

  1. Usage and activity information, including traffic data, logs, pages viewed, access dates and times, browsing activity, and other data relating to Your use of the Services; and

  1. You may choose not to provide certain Personal Information requested by Us; however, please note that the availability, functionality, or quality of the Services or certain features thereof may be affected where such information is required to provide the Services.

Any insufficiency, inaccuracy, or incompleteness in the information provided may affect Your ability to access or use the Services, the information provided to You through the Services, or Our ability to communicate with You.

  1. Consent: In most cases, We will process Your Personal Information based on Your prior explicit consent as required under Indian law, which You can withdraw at any time. In the event, You do not wish for Us to process Your Personal Information for any specific purpose, You retain the right to deny consent to Us for Use of Your Personal Information for such purpose. Please refer to Section 4 below to understand the different instances in which We collect Your Personal Information and the purposes for which We process Your Personal Information. While You have the right to withdraw the consent that You have given, certain Personal Information may be necessary to make available Our Platform and/or provide You with Our Services and We may not be able to provide You with. Please note that certain categories of Personal Information may be essential for Us to operate the Platform and deliver the Services. In such cases, if You choose not to provide such information, or withdraw consent for its processing, We may be unable to offer You access to specific Platform features.

Notwithstanding anything contained herein, We may, in compliance with applicable laws in India, process Your Personal Information without obtaining Your consent in the event: (i) You voluntarily provide Your Personal Information to Us and do not indicate anything to show that You do not consent to the use of such Personal Information by Us. Further, if You voluntarily provide Your Personal Information to Us for any of the purposes under Section 4, We shall not process Your Personal Information for any of the other purposes, unless You specifically voluntarily provide Your Personal Information to Us for any and / or all of such other purposes; (ii) the purpose of processing is for fulfilling any legal obligation to disclose any information to the State or any of its instrumentalities subject to such processing being in accordance with the provisions regarding disclosure of such information in any other law for the time being in force; (iii) it is for employment purposes or for defending Ourselves from any loss or liability in the context of employment; (iv) it is for compliance with any judgment, decree, or order issued under any Indian law or any judgment, decree, or order relating to civil contractual claims under any foreign law; (v) it is for responding to a medical emergency involving a threat to life or immediate threat to Your health or of any other Users’ health; (vi) it is for taking measures to provide medical treatment or health services to You or any other User during an epidemic, outbreak of disease or any other threat to public health; (vii) it is for the purpose of taking measures to ensure safety of, or provide assistance or services to, any individual during any disaster, or any breakdown of public order; and (viii) it is in the interest of prevention, detection, investigation or prosecution of any offence or contravention of any law for the time being in force in India.

  1. The Platform is not intended for use by children (i.e., individuals below 18 years of age). We do not knowingly collect or process Personal Information from children, nor do We encourage children to access or use the Platform or the Services. We do not accept any responsibility or liability for any use of the Platform by a person who is a child, or for any resulting claims by their parents or lawful guardians, as applicable

We will only collect and process Your Personal Information in accordance with applicable laws. We collect and use Your Personal Information by way of the following means:

We may collect Personal Information directly from You when You provide it to Us through Your access to or use of the Services, including when You register on the Platform, submit information through features or functionalities of the Platform, or otherwise interact with Us in connection with the Services.

How do We use this Personal Information: We use the Personal Information collected directly from You for the following purposes:

  2. to process Your requests and provide services or support raised by You in relation to the Services;

We may collect Personal Information automatically as You navigate, access, or use the Services, which may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies. We may also receive Personal Information about You from other sources, including Our affiliate entities and third-party sources such as analytics providers and advertising networks, identity and profile-related service providers, and publicly available sources. Such information may include technical data and other personal or non-personal information, and may be combined with Personal Information collected directly from You, in accordance with this Privacy Notice and applicable laws.

How We use this Personal Information: In addition to the purposes set out above, We use the information collected or generated under this section for the following purposes:

Disclosure during change of control: Based on Your consent, We may share Your Personal Information with Our parent company, subsidiaries, and affiliates as a result of a sale, acquisition, merger, reorganisation, or other change of control. We may also disclose and transfer all such information: (i) to a subsequent owner, co-owner, or operator of the Services or applicable database; or (ii) in connection with a corporate merger, consolidation, restructuring, the sale of substantially all of Our membership interests and / or assets or other corporate change, including, during the course of any due diligence process.

Further, We may use IP addresses or other device identifiers, to identify users, and may do so in cooperation with third parties such as copyright owners, internet service providers, wireless service providers, and / or law enforcement agencies, including disclosing such information to third parties, where it is required by law or is in pursuance to any subpoenas, governmental requests, orders from government authorities or investigative agencies, or legal processes requiring the requisite details. Such disclosures may be carried out without notice to You.

We provide You with the following rights about Your Personal Information as per applicable laws. Your rights are:

Right to access information: You have the right to ask Us: (i) for a summary of Your Personal Information being processed by Us and the processing activities undertaken by Us with respect to such Personal Information; (ii) the identities of all other third-party entities with whom Your Personal Information has been shared by Us, along with a description of the Personal Information so shared; and (iii) such other information that may be mandated for us to provide You under applicable law. However, this right has certain limitations as prescribed under applicable law.

  1. Right to modify / rectify information: You have the right to correct or update any information, including Your Personal Information. In the event You notice that any Personal Information already provided by You is inaccurate or incomplete or needs to be updated, You can ask Us to rectify such Personal Information (if the same cannot be done at Your end through the Platform) by contacting legalsupport@meesho.com. Further, if any Personal Information already provided by You is inaccurate, incomplete, or outdated, then You must give Us the accurate, complete, and up-to-date Personal Information by writing to Us at the email ID provided above, and We shall accordingly rectify such Personal Information at Our end. We urge You to ensure that You always provide Us with accurate and correct information / data to ensure that Your use of Our Services is uninterrupted. In case of any such modification of Personal Information, You may be required to furnish supporting documents relating to the change in Personal Information for verification. Any loss or damage accruing due to provision of inaccurate information or failure to update Your details, will be Your sole responsibility, to Our total exclusion.

  1. Right to erasure: You have the right to request the deletion or removal of Your Personal Information where there is no compelling reason for Us to keep it. Such right of erasure can be exercised by writing to Us at legalsupport@meesho.com, which must be in a format prescribed by the government, when available. For now, You may write to Us on the above email, to exercise this right. On such an erasure request, We shall delete all of Your Personal Information stored by Us. We shall also ensure that any third-party service provider processing Your Personal Information on Our behalf deletes all Your Personal Information, unless retention of the same is necessary for providing the Services or for compliance with any applicable law for the time being in force. Upon such erasure request being made by You, We will undertake the necessary deletion within a reasonable time and will cease processing Your Personal Information, except as may be permitted under applicable law. Please note that We may not be able to allow You access to Our Website and / or provide Services, subsequent to Your exercising of this right.

  1. Right with respect to consent: In certain instances, before collecting Your Personal Information, We take Your free, specific, informed, unconditional, unambiguous, and explicit consent. You can deny consent for the use of any particular information or revoke the consent already given. You shall have the following rights about Your Personal Information collected by Us:

To withdraw Your consent for the use, processing, disclosure, sharing or transferring of any Personal Information, You may mail Us at legalsupport@meesho.com. However, please note You will not be able to withdraw consent to the collection of necessary cookies, which enables Us to display the Platform on Your browser. Your withdrawal of the consent will not affect the lawfulness of processing of Personal Information based on Your consent before its withdrawal. In such an event, You are responsible for the consequences of such withdrawal of consent, and We do not provide a guarantee of Services if any such option to withdraw consent is exercised.

If You do not provide Your consent or later withdraw Your consent, We reserve the right not to offer You a Service on the Platform, if such Personal Information was relevant for provision of the Service and / or Platform.

In scenarios of withdrawal, We may delete Your Personal Information or other information We had earlier collected and stored, or de-identify it so that it is anonymous and not attributable to You.

Upon receiving a request for deletion of Your Personal Information, or withdrawal of consent for the processing of Personal Information, We shall not retain Your Personal Information if We no longer need it, and there is no legal requirement to retain the same. Do note that multiple legal bases may exist in parallel, and We may still have to retain certain data and information at any time.

  1. Right to nominate: You shall have the right to nominate any other individual, who shall, in the event of Your death or incapacity, exercise Your rights in relation to Your Personal Information, per applicable law in India.

  1. The applicable laws prescribe certain duties that You must adhere to. As part of Your duties, You need to ensure that You:

  1. We have reasonable security measures and safeguards in place to protect Your privacy and Personal Information from loss, misuse, unauthorised access, disclosure, destruction, and alteration of the information in compliance with applicable laws.

As long as You access and / or use the Platform (directly or indirectly), it is Your obligation, at all times, to take adequate physical, managerial, and technical safeguards, at Your end, to preserve the integrity and security of Your data which shall include and not be limited to Your Personal Information.

We or any of Our partners do not assume any liability or responsibility for disclosure of Your Personal Information due to errors in transmission, unauthorised third-party access, or other causes beyond Our reasonable control. You understand and acknowledge that We cannot ensure or warrant the security of any Personal Information You transmit to Us or guarantee that Your Personal Information may not be accessed, disclosed, altered, or destroyed by a breach of any of Our security measures and safeguards. In the event of any actual or suspected security incident, including data breach, We will take all measures required to be undertaken under applicable laws. You play an essential role in keeping Your Personal Information secure. You shall not share Your Personal Information or other security information of Your Account with anyone. We have undertaken reasonable measures to protect Your rights of privacy concerning Your usage of the Platform controlled by Us and Our Services. However, We shall not be liable for any unauthorised or unlawful disclosures of Your Personal Information made by any third parties who are not subject to Our control. In the event of any actual or suspected security incidents, including data breaches, We will take all measures required to be undertaken under applicable laws.

  1. For how long do We retain Your Personal Information?

We ensure that Your Personal Information, which is in Our possession or under Our control, is destroyed and / or anonymised as soon as, as per applicable law (if mandated), it is reasonable to assume that (i) the purpose for which that Personal Information was collected is no longer being served by the retention of such Personal Information; and (ii) retention is no longer necessary for any other reason including applicable law.

We reserve the right to amend this Privacy Notice from time to time to ensure that this Privacy Notice is consistent with any developments to the Platform and Services, the way We use Your Personal Information and any changes to the applicable laws including applicable data protection laws. We will make the updated Privacy Notice available on the Platform. We will notify You of any changes to this Privacy Notice by way of an email. You will be required to provide Your consent and acceptance to the updated Privacy Notice before You can continue accessing the Platform and the Services after such change. We encourage You to visit the Platform from time to time to ensure that You are well informed about Our latest policies concerning personal data protection. All communications, transactions and dealings on the Platform shall be subject to the latest version of this Privacy Notice in force at the time.
